Step by step

1

Report the damage quickly

Most policies set a deadline to report. The Texas Department of Insurance (TDI) notes that some policies allow one year from the loss.

2

Take photos and make only temporary repairs

Photos and video before touching anything. You can tarp the roof to prevent more damage. Keep the receipts.

3

The insurer acknowledges your claim

In Texas the company has 15 days to acknowledge the claim, and may ask for a signed proof of loss.

4

The adjuster inspects

The adjuster inspects the roof and writes the estimate. TDI recommends being there, with your contractor present too.

5

Decision and payment

The insurer accepts or denies within 15 business days of getting everything it asked for (up to 45 days if it explains why). If it accepts, it pays within 5 business days.

6

If the damage is worse

You or your contractor can ask the adjuster to raise the estimate. The industry calls this a supplement.

ACV vs RCV: why you get two checks

With a replacement cost (RCV) policy, insurers usually pay in two parts: first the estimate minus depreciation and the deductible, then the recoverable depreciation once they get the invoice for the finished job. With an actual cash value (ACV) policy, depreciation is not paid back.

TDI example: 10-year-old roofRCVACV
Replacement cost$10,000$10,000
Deductible$2,000$2,000
Insurance pays$8,000$5,000

If you have a mortgage, the check is made out to you and the mortgage company.

What State Farm says about contractors

  • You choose the contractor. State Farm says so on its roof claims page.
  • Ask for a detailed written estimate: materials (vents, flashing), labor, dates, payment terms, permits and warranty.
  • Check the contractor's liability insurance, references and track record.

In Texas a contractor cannot pay or waive your deductible (Insurance Code §707.002). If someone offers it, that's a red flag.

If you disagree

Talk to the adjuster first. You can also request an appraisal, hire a public adjuster or call the TDI help line at 800-252-3439. Texas law generally gives you 2 years to sue.
